Kosovo Publishes List of Standards Demonstrating Presumption of Conformity with Toy Safety Regulation

The Republic of Kosovo has published its first list of toy safety standards that show presumption of conformity with its toy safety legislation – Regulation (MTI) No. 02/2017 of March 6, 2017.

Published on September 5, 2019, the list contains both harmonized Kosovan standards (SK EN) and harmonized European Union (EU) standards (EN) that are considered to demonstrate conformity with Article 10 of the Regulation.

These are:
• Mechanical and physical – SK EN 71-1:2014+A1:2019 & EN 71-2014+A1:2018
• Flammability – SK EN 71-2:2011+A1:2018 & EN 71-2:2011+A1:2014
• Migration of certain elements – SK EN 71-3:2013+A3:2018 & EN 71-3:2013+A3:2018
• Experimental sets for chemistry and related activities – SK EN 71-4:2013 & EN 71-4:2013
• Chemical (sets) other than experimental sets – SK EN 71-5:2018 & EN 71-5:2015
• Finger paints – SK EN 71-7:2014+A2:2019 & EN 71-7:2014+A2:2018
• Activity toys for domestic use – SK EN 71-8:2019 & EN 71-8:2018
• N-Nitrosamines and N-nitrosatable substances – SK EN 71-12:2019 & EN 71-12:2013
• Olfactory board games, cosmetic kits and gustative games – SK EN 71-13:2019 & EN 71-13:2014
• Trampoline for domestic use – SK EN 71-14:2014+A1:2019 & EN 71-14:2014+A1:2017
• Electric toys – SK EN 62115:2011 and:
o i. EN 62115:2005
o ii. IEC 62115:2003 (modified)+A1:2004
• Electric toys – EN 62115:2005/A11:2012/AC:2013
• Electric toys – EN 62115:2005/A11:2012
• Electric toys – EN 62115:2005/A12:2015
• Electric toys – EN 62115:2005/A2:2011/AC:2011
• Electric toys –
o EN 62115:2005/A2:2011
o IEC 62115:2003/A2:2010 (modified)

Stakeholders should note the European standards are identical to those published under Commission Communication 2018/C 282/02 of June 2018.

Kosovo’s Regulation (MTI) No. 02/2017 of March 6, 2017, lays down the rules associated with toy safety and free movement in the domestic market. It is essentially based on the principles and requirements of Directive 2009/48/EC, the so-called Toy Safety Directive.

It therefore covers, among other requirements:
1. Complying with essential safety requirements – general safety, and particular safety in Annex II (physical and mechanical properties, flammability, chemical properties, electrical properties, hygiene and radioactivity)
2. Obligations for economic operators (manufacturers, authorized representatives, importers and distributors)
3. Requiring warnings and safety instructions to be written in the official languages of the Republic of Kosovo (the official languages of Kosovo are Albanian and Serbian)
4. Declaration of conformity (DoC, Annex III) – to be kept for 10 years after the toy has been placed on the market
5. Technical documentation in the official languages of Kosovo or one of the official languages of the European Union (EU), subject to a language that is acceptable to the authorities – to be kept for 10 years after the toy have been placed on the market
6. Transitional provisions relating to the accession of Kosovo to the European Union (EU)

The list became effective in October 2019.
